Child Support
Everyone who goes through a divorce in Rhode Island where there are children involved will have to deal with child support issues. Although the state provides very strict guidelines that determine how much will need to be paid and by whom, there is still a great deal of misunderstanding around what expenses are covered.
Bethany Macktaz can help you understand the child support guidelines and how they will apply to your situation.
There are many characteristics and factors, other than how much money you make, that the court takes into consideration when reaching a figure for child support. Among them are:
- whether the child has financial resources
- the custodial parent's financial resources
- what the child's standard of living would be if the marriage were not being dissolved
- whether there are any educational needs of the child
- the physical and emotional condition of the child
- the non-custodial parent's financial resources
Another misconception among divorcing couples is that the parent paying child support must pay that amount for the entire life of the child no matter what financial changes occur in their own life. Nothing could be further from the truth. Although child support is typically paid until a child reaches the age of 18, non-custodial parents who are paying support for their children have the right to ask the court to modify the amount they are paying based on a change of circumstance.
